THE UPSTREAM BORDER Artificial Intelligence and the Unbundling of Economic Sovereignty

概要:<p><span>International trade law and economic sovereignty developed around a physical convention: economically valuable transactions became legible when goods crossed territorial borders. Artificial intelligence weakens this convention by separating technical quantity, commercial value, compute location, technology ownership, physical resource use, customer location, and rent capture. This paper develops a conceptual framework for what is termed the upstream border: the migration of sovereign leverage away from the final digital output and toward the physical, legal, and institutional layers required to produce it.</span></p><p><span>The paper advances six related propositions. First, Japan retains disproportionate leverage in selected semiconductor materials and equipment despite limited ownership of frontier AI models. Second, the July 2023 tightening of Japanese semiconductor-equipment export controls is associated with a compositional shift in exports to China toward mature-node and uncontrolled tools. Third, AI scale-up makes electricity, cooling water, grid connections, and land increasingly binding location constraints. Fourth, generative AI converts apparently intangible computation into a thermodynamic infrastructure problem. Fifth, low-cost power jurisdictions in Central Asia can become compute enclaves, but headline investment need not translate into commensurate domestic value capture. Sixth, AI-era state power is functionally distributed across model architecture, fabrication, upstream inputs, regulation, energy hosting, and market access rather than concentrated in a single sovereign stack.</span></p><p><span>The empirical material is comparative and illustrative rather than causal. Cases include Thailand, Japan, the United States, China, Kazakhstan, Uzbekistan, Taiwan, the Netherlands, and South Korea. The central claim is not that borders disappear. Rather, the final AI output becomes less territorially legible while strategic control migrates upstream to semiconductor inputs, fabrication capacity, grid access, energy, land, taxation, licensing, regulation, and social license.
